General AI Models (GPAI)

Foundation models like ChatGPT, GPT-4, or Claude fall under a special category of the AI Act. These General Purpose AI (GPAI) systems have specific compliance requirements you should know about.

Important GPAI Requirements for You

  • Transparency Obligations: You must disclose when content is AI-generated
  • Copyright Compliance: Summaries of training data are required

GPAI obligations have been active since 2 August 2025. If you use or develop foundation models, these requirements must already be fully implemented. The EU AI Office oversees compliance at the European level.

Your Obligations by Role

Depending on whether you develop, operate, or supervise AI systems, you have different obligations. Here you'll find an overview of your specific compliance requirements.

As Provider (Developer)

Your Core Obligations: Conformity assessment, risk assessment, technical documentation, data quality assurance. For high-risk systems additionally quality management system and post-market surveillance.

As Operator (User)

Your Core Obligations: Human oversight, system monitoring, record-keeping, personnel AI competence. You must monitor data inputs and correctly interpret outputs. Public bodies must additionally conduct a Fundamental Rights Impact Assessment (FRIA) before deploying high-risk AI.

As Authority

Your Core Obligations: Market surveillance, compliance monitoring, enforcement measures, guideline provision. Special responsibility in cross-border cooperation.

As GPAI Actor

Your Core Obligations: Training data summaries, copyright compliance, content labeling, systemic risk assessment. Abuse prevention and user guidelines are essential.

Penalty Structure for Violations

  • Prohibited AI Systems (Art. 5): Up to €35 million or 7% of global annual turnover
  • Provider/Operator Obligation Violations: Up to €15 million or 3% of global annual turnover
  • GPAI Model Violations: Up to €15 million or 3% of global annual turnover (e.g. missing transparency, no training data documentation)
  • False or Misleading Information: Up to €7.5 million or 1.5% of global annual turnover
  • Principle: The higher amount always applies. SMEs and startups may be subject to lower maximum fines.

AI in Focus: Energy Providers as Critical Infrastructure

As operators of critical infrastructures (KRITIS), energy providers are subject to the strictest rules of the AI Act. AI systems used for control, operation, and safety of energy networks are explicitly classified as high-risk applications. Additionally, the NIS2 Directive imposes parallel cybersecurity requirements for critical infrastructure operators that must be addressed in an integrated compliance strategy.

Grid Control & Stability

AI systems that control power flows in real time, distribute loads, or respond to fluctuations from renewable energies are high-risk applications. They require the highest levels of reliability and transparency in their decision-making processes (N-1 security).

Demand Forecasting

Systems that predict energy demand are critical for grid stability and pricing. Erroneous forecasts can have serious consequences, which is why high requirements apply to data quality and model validation.

Predictive Maintenance

AI for predicting failures in critical components (e.g. transformers, turbines) is classified as high-risk. Reliability must be demonstrated through rigorous testing and continuous monitoring.

DERMS & Smart Grid Management

Algorithms controlling virtual power plants (VPPs), microgrids, and smart grids must ensure safety, fairness, and data protection. Pipeline integrity monitoring also falls into this category.

Specific Obligations for Operators

The use of these systems requires compliance with a strict catalog of obligations:

  • Comprehensive Risk Management: Establish and maintain a continuous risk management process throughout the entire AI lifecycle.
  • High Data Quality & Governance: Use high-quality training, validation, and test datasets to minimize bias and maximize performance.
  • Complete Documentation & Logging: Detailed technical documentation with full traceability of all AI decisions.
  • Human Oversight: Qualified personnel must be able to monitor, question, and correct any AI decision at any time.
  • Conformity Assessment: Successfully complete a conformity assessment before the system is put into operation.
  • NIS2 Integration: Cybersecurity requirements of the NIS2 Directive must be met in parallel – an integrated compliance approach is strongly recommended.

What is the "Digital Omnibus" and what does it mean for my business? +
The Digital Omnibus is a legislative proposal by the European Commission from 19 November 2025. It proposes simplifying and delaying the high-risk obligations of the AI Act: Annex III (standalone high-risk AI) would be pushed to no later than December 2027; Annex I (AI in regulated products) to August 2028. Important: this is not yet law! Plan based on current legislation (August 2026 deadline) and monitor the legislative process.
Did the European Commission meet the February 2026 deadline for high-risk guidelines? +
No. The European Commission had a legal deadline of 2 February 2026 to publish guidance on classifying high-risk AI systems (Article 6). This deadline was missed. A further delay was confirmed on 25 February 2026. The guidelines are now expected in March/April 2026. This creates legal uncertainty – not a reason to wait, but a reason to follow developments closely.
