The Four Risk Categories of the AI Act

The EU AI Act classifies AI systems into four risk categories, each with different requirements and prohibitions. This classification determines which compliance measures you need to implement for your AI applications.

General AI Models (GPAI)

Foundation models like ChatGPT, GPT-4 or Claude fall under a special category of the AI Act. These General Purpose AI (GPAI) systems have specific compliance requirements you should know about.

Key GPAI Requirements for You

GPAI obligations have been active since 2 August 2025. If you use or develop foundation models, you must have fully implemented these requirements by now. The EU AI Office oversees compliance at the European level. The GPAI Code of Practice was finalized on 10 July 2025 in three chapters: Transparency, Copyright, and Safety & Security.

Phase 1: Completed (since Feb. 2025)

Bans are in effect. Anyone operating social scoring, manipulative AI or real-time biometrics must have shut down these systems. An inventory of all AI systems is mandatory.

Phase 2: Active (since August 2025)

GPAI compliance is in effect. Technical documentation, training data summaries and copyright compliance for foundation models are now binding.

Phase 3: Act now! (until August 2026 -- ~4 months remaining)

All high-risk AI systems must be compliant. Implement risk management, quality assurance, technical documentation and human oversight. Note: The Digital Omnibus could extend high-risk deadlines -- but nothing is decided yet. Plan based on current law!

Your Obligations by Role

Depending on whether you develop, operate or oversee AI systems, you have different obligations. Here you'll find an overview of your specific compliance requirements.

As a Provider (Developer)

Your core obligations: Conformity assessment, risk assessment, technical documentation, data quality assurance. For high-risk systems additionally: quality management system and post-market surveillance.

As an Operator (User)

Your core obligations: Human oversight, system monitoring, record-keeping, staff AI literacy. You must monitor data inputs and correctly interpret outputs. Public bodies must additionally conduct a Fundamental Rights Impact Assessment (FRIA) before deploying high-risk AI.

As an Authority

Your core obligations: Market surveillance, compliance monitoring, enforcement measures, guideline provision. Special responsibility for cross-border cooperation.

As a GPAI Actor

Your core obligations: Training data summaries, copyright compliance, content labeling, systemic risk assessment. Misuse prevention and user guidelines are essential.

Penalty Framework for Violations

AI in Focus: Energy Providers as Critical Infrastructure

As operators of critical infrastructure (KRITIS), energy providers are subject to the strictest rules of the AI Act. AI systems used for control, operation and safety of energy grids are explicitly classified as high-risk applications. Additionally, there are overlaps with the NIS2 Directive, which prescribes additional cybersecurity requirements for critical infrastructure.

Grid Control & Stability

AI systems that control power flow in real time, distribute loads or react to fluctuations from renewable energy are high-risk applications. They require the highest reliability and transparency in their decision-making processes (N-1 security).

Demand Forecasting

Systems that predict energy demand are critical for grid stability and pricing. Faulty forecasts can have serious consequences, which is why high requirements for data quality and model validation apply.

Predictive Maintenance

AI for predicting failures of critical components (e.g., transformers, turbines) must be classified as high-risk. Reliability must be demonstrated through robust testing and continuous monitoring.

DERMS & Smart Grid Management

Algorithms controlling virtual power plants (VPPs), microgrids and smart grids must ensure safety, fairness and data privacy. Pipeline integrity monitoring also falls under this category.

  • Comprehensive risk management: Establish and maintain a continuous risk management process across the entire AI lifecycle.
  • High data quality & governance: Use high-quality training, validation and test datasets to minimize bias.

  • Human oversight: Qualified personnel must be able to monitor, question and correct AI decisions at all times.

KI-MIG: German AI Implementation Act

National Implementation Law

The KI-MIG (KI-Marktüberwachungs- und Innovationsförderungsgesetz) was approved by the German Cabinet on 11 February 2026 and is currently in parliamentary process (Bundesrat/Bundestag). It governs the national implementation of the EU AI Act:

What is the EU AI Act and what is currently in effect? +

The EU AI Act is the world's first comprehensive AI regulation, in force since 1 August 2024. Currently (March 2026), banned practices include social scoring, real-time biometrics and other practices (since Feb. 2025). GPAI obligations have applied since Aug. 2025. Full high-risk compliance is planned for August 2026 -- however, the Digital Omnibus could still shift these deadlines.

Which AI systems are affected? +

All AI systems are classified into four risk categories: Unacceptable Risk (banned), High Risk (strictly regulated), Limited Risk (transparency obligations) and Minimal Risk (voluntary standards). The category determines your compliance requirements. High-risk AI includes systems in critical infrastructure, medicine, law enforcement and employment decisions.

How high are the penalties? +

Penalties are existentially threatening: from EUR 7.5M to EUR 35M or 1.5% to 7% of your global annual turnover -- whichever amount is higher. Banned AI systems and GPAI violations carry penalties of up to EUR 35M and EUR 15M respectively. Lower caps may apply for SMEs and startups.

What is the Digital Omnibus? +

The Digital Omnibus is a legislative proposal from the EU Commission dated 19 November 2025. It proposes simplifying and delaying the high-risk obligations of the AI Act: Annex III (standalone high-risk AI) would be postponed until December 2027 at latest, Annex I (AI in regulated products) until August 2028. Update March 2026: The Council adopted its general approach on 13 March 2026, and the European Parliament approved its position in plenary on 26 March 2026. Trilogue negotiations begin in April 2026, with agreement expected in May/June 2026. Both Council and Parliament positions include a new ban on AI systems generating non-consensual sexual/intimate content. Important: This is not yet law! Plan based on current law (August 2026) and keep an eye on the trilogue process.

Did the EC meet the Feb 2026 deadline for high-risk guidelines? +

No. The EU Commission had until 2 February 2026 to publish guidelines on classifying high-risk AI systems (Article 6). This deadline was missed. A second delay was confirmed on 25 February 2026. The guidelines are now expected for March/April 2026. This creates legal uncertainty -- not a reason to wait, but a reason to closely follow developments.
